1. DISPUTE RESOLUTION & ARBITRATION

If a disagreement or dispute arises regarding this agreement or the repairs performed on the vehicle, Customer and Crash Kings of Dallas agree to first attempt in good faith to resolve the matter through mediation administered by the American Arbitration Association under its applicable Consumer or Commercial Mediation Rules.

If mediation does not resolve the issue, any remaining dispute will be settled through binding arbitration administered by the American Arbitration Association under the applicable Consumer or Commercial Arbitration Rules.

Judgment on the arbitration award may be entered in any court with jurisdiction.
If either Customer or Crash Kings elects arbitration, the claim will be handled on an individual basis only — no class actions or representative claims are permitted.

Exception – Magnuson-Moss Warranty Act (MMWA):
Claims under the MMWA must first go through mediation but will not be arbitrated. If mediation does not resolve an MMWA claim, Customer may pursue that specific claim in court. All non-MMWA claims remain subject to arbitration as described above.
For any MMWA claim brought in court, both Customer and Crash Kings waive any right to a jury trial.

2. LIMITED WARRANTY

Subject to the terms and exclusions below, Crash Kings of Dallas warrants our repairs against defects in materials and workmanship for the applicable warranty period.

If a defect arises during the warranty period due to improper workmanship or materials, Crash Kings will repair or replace the affected part(s) at no charge, subject to these terms. All warranty repairs must be performed at a Crash Kings facility unless otherwise pre-approved by Crash Kings.

A. Warranty Period, Non-Transferable

Unless otherwise stated, Crash Kings’ limited warranty applies only to the Customer and only for as long as the Customer owns the vehicle, and never for fewer than sixty (60) days.
Warranty rights cannot be transferred or assigned to another owner.

B. Third-Party Parts & Manufacturer Defects

From time to time, Crash Kings may use parts or materials provided by outside manufacturers or suppliers. In these cases, Crash Kings warrants those items only to the extent they are covered by the third-party manufacturer’s own warranty.

C. Limitations & Exclusions

This warranty does not cover issues caused by:

• Unauthorized repairs or parts

• Improper vehicle maintenance

• Abuse, misuse, or neglect

• Alterations or modifications

• Accidents after repairs

• Repairs performed elsewhere (unless pre-approved by Crash Kings)

• Acts of God or other causes outside our control

All disputes related to this section will be handled according to Section 1 above.

D. Environmental Damage Excluded

This warranty does not apply to damage caused by environmental or road-hazard conditions including, but not limited to:
chemicals, tree sap, road salt, sand, rocks, pebbles, hail, sun, pollution, windstorms, or similar hazards affecting paint, trim, chrome, upholstery, vinyl, leather, wood, or fabric.

E. Parts Replacement & Ownership

By signing this agreement, Customer waives the right to retain replaced parts. All parts removed or replaced under this warranty become the property of Crash Kings of Dallas.
If you wish to keep replaced parts, you must notify the center manager before signing so arrangements can be made.

3. DISCLAIMERS

The limited warranty described in Section 2 represents the complete and exclusive warranty provided by Crash Kings of Dallas. No other warranties — written or oral — apply unless expressly stated in this agreement.

Crash Kings shall not be liable for any:

• Commercial losses

• Lost income or savings

• Special, indirect, or consequential damages

• Incidental or business-related losses

Even if Crash Kings has been advised of the possibility of such damages.

Where portions of this warranty conflict with applicable law, Crash Kings will follow the governing law.

4. ENTIRE AGREEMENT & VALIDITY

Customer acknowledges that no promises or representations outside this written agreement were relied upon in authorizing repairs.

This document constitutes the entire agreement between the Customer and Crash Kings of Dallas and supersedes all prior oral or written communication related to its subject matter.

Any modifications must be made in writing, signed by both Customer and Crash Kings (manual or digital signatures permitted).
